On Tuesday February 9, 2021 at 10:46 am a passerby reported to the Washington County Sheriff’s Office that a garage was on fire in the 3000 block of Kettle Moraine Road in the Town of Hartford.  The caller reported that heavy smoke could be seen coming from the structure.  A short time later the Washington County Dispatch Center received a 911 call from the homeowner reporting the garage fire. 

Deputies from the Washington County Sheriff’s Office responded and upon arrival of the first deputy the structure was found to be unoccupied with heavy smoke coming out of the roof line. The Hartford Fire Department arrived a short time later and upgraded the structure fire to the box level.  Hartford Fire Department was assisted by the following departments: St Lawrence, Slinger, Richfield, Ashippun, Iron Ridge, Hustisford, Neosho, Allenton, Mayville, West Bend, and Life Star Rescue. 

Kettle Moraine Road was closed for approximately four hours to assist in firefighting efforts.   There were no reported injuries to fire personnel as a result of the fire. As of this release the fire has been mostly extinguished, but Fire personnel are still on scene working on overhaul operations.  The building and contents were a total loss.  Initial lost estimate is $300,000.  The fire remains under investigation by the Washington County Sheriff’s Office.

Case:            Update to Town of Kewaskum Homicide

Today, the Wisconsin Department of Justice Division of Criminal Investigations, identified the individual killed during a shootout with a Washington County deputy on Wednesday, February 3, 2021, as 30-year-old Nicholas S. Pingel of West Bend.  The sheriff’s office confirmed that Nicholas Scott Pingel is the lone suspect involved in the crime spree immediately leading up to the officer-involved shooting that ended the threat to the community that day.

Detectives from the Washington County Sheriff’s Office and the West Bend Police Department, have been diligently working to establish the suspect’s pattern of behavior and whereabouts for the week leading up to the tragic sequence of events on Forest View Rd.

The Washington County Sheriff’s Office is releasing the following information concerning that aspect of the investigation.

Nicholas S. Pingel has had multiple contacts with area law enforcement agencies; contacts with the Washington County Sheriff’s Office date back to 2010 for a variety of minor investigations, civil forfeitures as well as misdemeanor and felony arrests.  From 2014 to 2016 Pingel was arrested for multiple burglaries and was ultimately sent to prison.  He has spent much of the past four years incarcerated in the state prison system.  He was released from prison on December 1st, 2020, and was placed on extended supervision with the Wisconsin Department of Corrections. 

At the time of his death, he had one pending misdemeanor criminal case in Washington County for battery and disorderly conduct as a result of a bar fight that occurred on December 12th of last year in the City of West Bend.  He was released from the Washington County Jail on December 15th after the probation hold was lifted.  That was the last negative local law enforcement encounter with Pingel until the deadly force encounter.   His residence at the time of his death was 150 N Main Street #8 in the City of West Bend which is Department of Corrections owned housing.

Interviews with immediate family members and associates suggest he struggled with substantial mental health issues for at least the past decade and was completely disconnected from direct family members for the week preceding the incident.  His behavior became increasingly erratic and Pingel displayed signs of extreme paranoia in the weeks leading up to his murderous crime spree.  It’s believed Pingel stopped taking his medication which helped him cope with his serious mental illness. 

Investigators, through interviews with known associates, determined Pingel stayed at an acquaintances apartment in the central portion of the City of West Bend starting on Friday, January 29th.  Due to his erratic, but non-threatening behavior, he was asked to leave the apartment the following day.  Evidence suggests he may have been covertly staying overnight in the common basement area of that apartment for the nights leading up to Wednesday morning. 

Interviews also suggest that drug use could be a contributing factor to his erratic behavior as well. Preliminary toxicology tests showed the presence of marijuana.  Further, more comprehensive toxicology results are pending. 

Through a neighborhood canvas of the northeastern quadrant of the City of West Bend, investigators obtained video footage of Pingel alone about ½ mile from the area the car was initially stolen on Marcia Ave. in the City of West Bend. Based upon this information, there is conclusive evidence that he acted alone.

Washington County Sheriff Martin Schulteis released the following statement, “As a community and an agency, we continue to try and process the horrific events of last week that occurred at the hands of this man.  I understand the fear, pain, and anxiety that many in Washington County are experiencing surrounding these events.  Random violence is rare in Washington County, people have the right to feel safe within their homes, and these horrific crimes that terrorized so many called into question that very right.  The victims, their families, and this community deserve answers to better understand what could cause someone to act out in such a violent manner, this is why we are releasing the information today.  We can provide some clarity, unfortunately, a lot of questions remain unanswered.  We as an agency stand with and mourn alongside those affected by this horrific tragedy, we are doing our part to help the community begin to heal.  We are grateful for the outpouring of support for the victims and our agency from the people of Washington County. Finally, I ask that you join me in keeping those affected by the events of February 3rd in your thoughts and prayers as we start the healing process.”

Washington County Sheriff’s Office investigators are continuing to piece together the tragic events that occurred on Forest View Road in the Town of Kewaskum on Wednesday afternoon which resulted in the deaths of three Washington County men.

The sheriff’s office is receiving assistance from the Wisconsin State Patrol and the West Bend Police Department.

The Wisconsin Department of Justice Division of Criminal Investigation continues leading the investigation into the officer-involved shooting by conducting an independent investigation into the death of the suspect in accordance with state law.

Washington County Sheriff Martin Schulteis is committed to maintaining the integrity of the investigative process while also fulfilling his commitment to transparency within the community.  As a result, we are releasing the following information on the current investigation.

The tragic events began on Wednesday afternoon around 2:30pm when a 30-year-old City of West Bend man stole a car in the City of West Bend.  At around 2:45pm the suspect crashed the car on Forest View Road north of Ridge Road in the Town of Kewaskum after he failed to negotiate a curve which resulted in a roll-over accident.  The suspect was able to self-extricate himself and forced entry into a nearby unoccupied residence.  At the same time, a 52-year-old Port Washington women came upon the accident and pulled over to check to see if anyone needed assistance.  She encountered the suspect who physically assaulted her and attempted to take her car. The suspect crashed that car while leaving the driveway. 

The suspect then ran to another nearby residence in the 8100 block of Forest View Road.  At 2:50pm he forced entry into the locked front door of the home and encountered the homeowners. He demanded and obtained their car keys.  He attempted to drive away but was not able to get the car started.  He came back into the residence and physically assaulted the elderly couple.  The suspect once again exited the home in an attempt to steal the car. The male homeowner retrieved a handgun for protection.  Tragically, the suspect was able to overpower the victim and took control of the gun.  He then fatally shot the 72-year-old male homeowner.  The suspect then attempted to shoot the wife but the firearm did not fire.  The suspect then fled on foot to another residence in the 8200 block of Forest View Road where he encountered another resident.  The suspect obtained a shotgun in the home and fatally shot the 77-year-old male resident just outside his garage.  The suspect then fled the residence.  This homicide was unwitnessed.  All of the victims throughout this incident were random and unknown to the suspect.

Moments later, the first arriving deputies encountered the armed suspect on Forest View Road near the scene of the second homicide as he was leaving that area around 3:05pm.  The deputy and the suspect exchanged gunfire and the suspect was struck with a law enforcement round.  A perimeter was established and a drone located a subject matching the suspect’s description a short distance north of the deputy(s) initial encounter.  Officers approached and located the suspect deceased from an apparent gunshot wound.  A firearm was also located near the decedent.

The shooting deputy is a nine-year veteran of Washington County law enforcement and has been placed on administrative leave as a standard protocol pending the outcome of the independent investigation. He was not injured as a result of this incident.

Sheriff Schulteis said, “This horrific incident has struck this community and our agency at its core.  We lost two valuable members of our community at the hands of this senseless crime spree.  Their absence will impact many and we mourn with you.  Our thoughts, prayers, and sympathies go out to the surviving victims and families of the deceased whose lives are forever changed. There are many more questions to be answered as to why this occurred.  I assure the community that investigators are working diligently to be able to provide those answers.  In the meantime, we ask that the public respect the privacy of the victims and their families and allow them to grieve.”

Sheriff Schulteis finally added, “Our deputies never want to be placed in the position where they are required to use lethal force against our citizens.  I am proud of the overwhelming law enforcement call to action which no doubt mitigated further violence from occurring; however, that does not provide peace to the loved ones of our victims. I believe the deputy’s actions were tragically necessary to protect the deputy and the community he took an oath to protect. Ultimately the independent investigation will be forwarded to the Washington County District Attorney’s Office to review, but our deputy’s actions ended a murderous rampage within our community.”

Subject: Home Invasion/Officer Involved Shooting #21-4120

On Wednesday February 3, 2021 at approximately 2:50 p.m., the Washington County Sheriff’s Office received a landline 911 phone call from a resident in the 8100 Block of Forest View Road in the Town of Kewaskum reporting a subject that forced his way into the residence demanding the keys to a vehicle. Deputies and an officer from the Kewaskum Police Department were subsequently dispatched to the scene. At approximately 2:56 p.m. a second 911 call from a neighboring residence reported hearing shots fired and observed an armed subject walking towards the caller’s residence. Upon deputy(s) arrival, there was an exchange of gunfire with the armed suspect, followed by the suspect fleeing on foot. A perimeter was established and a drone located a subject matching the suspect’s description a short distance north of the deputy(s) initial encounter. Officers approached and located the suspect deceased from an apparent gunshot wound. A firearm was also located near the decedent.

Additional responding deputies located a deceased subject outside the first 911 caller’s residence. A witness stated that the resident had been shot by the armed suspect prior to law enforcement’s arrival.

While there is no longer a threat to the community, roadways in the immediate area will remained closed to facilitate the ongoing investigation. As such, motorists are requested to avoid the area. The Washington County Sheriff’s Office is investigating the death of the local resident. The Wisconsin Department of Justice Division of Criminal Investigation has also been requested by the Sheriff’s Office to investigate law enforcement’s shooting of the suspect.

This is a fluid and ongoing investigation, and no additional information or names are being released at this time. Additional information will be released by the appropriate agency once it becomes available.
